To all Non-Resident Students：

According to the law of Macau, if Non-resident Students are no longer studying at Macau University of Science and Technology because of dropping out, suspending schooling, finishing studies early, failure to complete the program, terminated, transfer to other university, continuing to take other course in the same university after completing a degree and so on, they should cancel their original “Special Authorization to Stay” and apply for ordinary “Authorization to Stay” for departure from Macau.

A notification will be sent to the Stay Subdivision of Residence and Stay Affairs Department when Non-resident Students are no longer studying at Macau University of Science and Technology and their “Special Authorization to Stay” will be terminated. Upon the completion and approval of the school leaving procedure[1], students should proceed to Stay Subdivision of Residence and Stay Affairs Department as soon as possible for the cancellation of “Special Authorization to Stay” and make a departure within prescribed period[2]. If there is any need, students should apply for ordinary “Authorization to Stay” for the purpose of extension of stay and departure from Macau in order to avoid overstaying in Macao. If students transfer to the other university or continue to take other course in the same university after completing a degree, they need to apply a new “Special Authorization to Stay” at the Stay Subdivision of Residence and Stay Affairs Department before the expiry of the ordinary “Authorization to Stay”.

Upon completion and approval of the school leaving procedure, students who do not apply for “Authorization to Stay” accordingly but just possess the original “Special Authorization to Stay”, and students who do not depart in the prescribed period after abolition of “Special Authorization to Stay”, will become “over-stayers” and suffer the Penalty (refer to the appendix for detail).

Kindly remind that please comply with the law. The public announcement of the Macau Government shall prevail in the relative law.

Appendix: Penalty for Overstay

 According to Article 58 of Law No. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region”, non-residents who overstay not because of non-imputable justified reasons will be deported and may be interdicted from entry and prohibited from making applications for Residence Authorization or Special Authorization to Stay for two years starting from the expiry of the entry interdiction period. If a non-resident overstays for not more than 30 days, is not a repeated offender of such infraction and pays the minimum fine (MOP 500 per overdue day) upon giving himself or herself to the police or immediately after he or she is discovered, the above stipulation is not applicable. In addition, according to Article 94 of Law No.16/2021, repetition of the same infraction within 1 year from the date the decision of administrative penalty becomes unappealable and any new administrative infraction committed within 5 years from the previous infraction are considered to be recidivism.
