Dean Shen Weixing of the School of Law, Tsinghua University presented in "Shizi Gate” Master Lecture of Faulty of Law, Macau University of Science and Technology on Privacy, Information, Data under the Chinese Civil Code

On April 23, 2021, at 3:00 pm, the 19th session of the Shizi Gate Master Lecture at the Faculty of Law of the Macau University of Science and Technology (the second session of the 2020-2021 academic year) was successfully held in the N101 Lecture Hall. This event was organized by the Faculty of Law MUST and sponsored by the Macau Foundation and the Macau University of Science and Technology Foundation. Dean Professor Shen Weixing of School of Law, Tsinghua University was invited to be the guest speaker for this event, and the topic of his lecture was on Privacy, Information, and Data under the Chinese Civil Code.

Professor Shen is currently the Dean of School of Law, Tsinghua University, doctoral supervisor, the fourth "National Ten Outstanding Young Jurists" (2014), Fulbright Visiting Scholar at Harvard Law School (2009), and Humboldt Scholar in Germany (2015). He is also the Executive Director of the China Law Society, the Vice President of the China Law Society Network and He is also the Executive Director of the China Law Society, Vice President of the China Law Society Network and Information Law Research Association, and Vice President of the China Law Education Research Association.

In the lecture, Professor Shen firstly reviewed the legislative process of the Civil Code of the People's Republic of China, and explained the status of personality rights in the Civil Code by analyzing the structure of the Civil Code. Then, based on the distinction between privacy, information, and data, Professor Shen stressed that the Civil Code has regulated these areas to different degrees and formed a clear pattern of differences. Finally, by analyzing classic cases such as "Sina v. Maimai" and “the Battle between Toutiao and Tecent", Professor Shen raised the issue of the appropriateness of the data ownership allocation rules. He advocated for the adoption of an empowering model for data regulation that constructs a binary right structure of the originator's ownership rights and the data processor's usufruct rights.

During the interactive session, law students actively asked questions and the academic atmosphere was strong, and the whole forum lasted for two hours. Professor Shen's insightful and constructive viewpoints broadened the theoretical horizons of the law school faculty and students. More than 100 faculty and students attended the forum, including Dean Fang Quan, Program Director Xie Gengliang, Program Director Bi Jingwei, Associate Professor Lin Weiqiang, and Assistant Professor Zhang Changmian.
