“The successful implementation of the Basic Law in Macau” was held by Faculty of Law on 29 November.  This forum was organized by Peking University Alumni Association of Macao, and was jointly organized by Faculty of Law in M.U.S.T.  It was also supported by Peking University Law School, Centre for Constitutional Law and Basic Law Studies and Peking University Alumni Association of Macao.  It was as well as sponsored by Macao Foundation.  Wang Heng (Vice-Minister of Liaison Office of the Central People's Government in the Macao Special Administrative Region), Mr. Liu Dexue (Director of Direcção dos Serviços de Assuntos de Justiça), Professor Pan Jianfeng (Dean of Peking University Law School) and his delegation, teachers and students from Faculty of Law in M.U.S.T. were participated in the captioned forum.

Pan Jianfeng, Dean of Peking University Law School mentioned in the opening ceremony that this year was not an ordinary year, even so it was a year to welcome the 70th anniversary of the China establishment and the 20th anniversary of the Macau Handover Day.  At the same time, we also encountered some challenges in the Sino-US trade war and also in Hong Kong.  However, our country should be able to overcome all the difficulties and achieve the greater success.  Moreover, he also mentioned that Peking University Law School is one of the major Liberal Art institute, aiming at nurturing the talents and which had achieved a very good result in this.  Nowadays, the outstanding alumni from Faculty of Law were found in every different profession.  During this duo of anniversaries, it had a special significance for the experts, friend and students from different fields to gather together to have an in depth exchange on the Macau Basic Law.

Mr. Liu Dexue, Director of Direcção dos Serviços de Assuntos de Justiça, pointed out in the speech that after two decades of the successful implementation of the Macau Basic Law, it has changed from an abstract system to a concrete practice system.  The foundation of “One Country” has been consolidated and the “Two Systems” has also been developed adequately.  Completely and accurately implement the Basic Law and perfectly carry out the policies which tie up the legal system in Macao SAR.  He believed that the future of Macau will be more flourishing under the “One Country Two Systems”.

Professor Rao Geping from Peking University Law School and Beijing Institute of Hong Kong Macau Scholars, presented a speech after the opening ceremony, the speech was regarding the “March towards to the new goal of One Country Two Systems practice – Repeat the election political program of the Chief Executive-elect”.  “The Political Program” which issued by the Chief Executive-elect, Mr. Ho Iat Seng, in August this year was the new blueprint for the implementation of “One Country, Two Systems” for Macau future.  Moreover, this Program caused the widespread attention of the Macau citizens.  Professor Rao Geping deciphered the “Political Program” by governance philosophy, strategy for governing Macau and governance concept.  Professor Rao expressed that the “Political Program” considered the stability as the foundation and aimed at reforming and innovation as the goal.  Professor Rao also mentioned that he looked forward to the entire implementation of the “Political Program” from Mr. Ho Iat Seng.  

Professor Chen Duanhong believed that constitution and Basic Law are the relationships between Superordinate Law and Subordinate Law.  Professor Chen pointed out that the formulation of the Hong Kong and Macau Basic Law comprised the constitutional moment.  The setup of the Hong Kong and Macau Basic Law is according to the constitution, and the Constitution was just like the “Main Law” and the Basic Law was just like the “Branch Law”.  The Basic Law of Hong Kong and Macau is the Constitution that authorized by the National People’s Congress which made certain provisions of the Constitution based on the actual conditions of Hong Kong and Macau.

Professor Zhan expounded that the positive interaction between the Government and the society under the rule of law in Macau.  In his opinion, some details data showed that Macau has experienced a remarkable development after the handover day.  Under the “One Country, Two Systems”, the Macau executive-led and legislature are coordinated and restricted each other. This is a unique feature in Macau.  

Professor Wang Lei discussed the topic “Live Constitution and Basic Law” and the relationship between the Basic Law and local legislation of Hong Kong and Macau.  In his opinion, the setup of the Basic Law of Hong Kong and Macau is according to the Constitution, but not according to the Sino-British and Sino-Portuguese Joint Declaration.  The Constitution is effective and applicable in the Special Administrative Region.  The Constitution could be directly applied in the Special Administrative Regions, if there is anything involves the National affairs and the concerns with the Central and Special Administrative Regions.  The Basic Law of Hong Kong and Macau is the superordinate law of the local legislation in the Special Administrative Regions.  When analyzing the restrictions of residents’ behavior by local legislation, it was necessary to handle well the relationship between the residents’ basic rights and public benefits; as well as the relationship between the different authorities’ organizations of the Special Administrative Region.

Professor Zhu Guobin discussed in the speech that whether Hong Kong can replicate the successful experience of Macau or not.  He believed that Macau is successful in items of social security, economic aspect, rights protection, district and International position.  From the point of view of the constitutional and legal, there were seven factors that Macau could be so successful, which were: Macau SAR implement the Basic Law effective, excellent executive leadership, Macau courts upheld judicial modesty, the Central Government had a significant presence in Macau SAR, a successful constitutional transformation in Macau SAR, Macau SAR fulfilled its National Security Legislative Obligations energetically and successful national education.  He also believed that Hong Kong had to rebuild the confidence in order to get out of its predicament.  Moreover, this was also including to rebuild the trust between the Hong Kong citizens and Hong Kong Government as well as between the Central Government and the Hong Kong society.
